The Spill Prevention, Control, and Countermeasure (SPCC) Rule is a U.S. EPA Federal Regulatory Program which is intended to prevent the spill and discharge of oil from reaching navigable waters of the United States and adjoining shorelines. This program is critically important as the discharge of oil to surface water has the highest potential for causing adverse environmental and human health impacts.

Under the SPCC rule, certain oil handling and storage facilities are required to prepare and implement an “SPCC Plan” to demonstrate compliance with the regulation. The purpose of an SPCC Plan is to develop a comprehensive description of:

  • Oil Handling Operations
  • Storage Capacities
  • Spill Prevention and Cleanup Practices
  • Personnel, Training, and Control Resources

Compliance with SPCC regulations requires more than development of a “Plan”, – it requires Implementation of the Plan - and that means: Administration, Recordkeeping, Training, and continued Maintenance.

Who is Covered by the SPCC Rule?

Any non-transportation related facility operation that could reasonably be expected to discharge oil into navigable water of the U.S., and has a total aboveground storage capacity of 1,320 gallons or more of “oil” meeting the EPA definition. The SPCC Rule is more than a regulatory requirement as qualifying facilities, farms, and ranching operations could face fines up to $32,500 per day for non-compliance. No matter who certifies your SPCC Plan, the owner or operator is ultimately responsible for implementation and compliance with the rule.
